1. The agreement
These Terms of Service (“Terms”) are a binding contract between you and My Friendly Staff (“we,” “us,” or “our”). They govern your access to and use of our website at myfriendlystaff.com, the My Friendly Staff hiring platform, the AI phone agent, the Sign Shop, and any related services (together, the “Service”).
By creating an account, clicking “I agree,” or using the Service, you agree to these Terms and to our Privacy Policy. If you are using the Service on behalf of a business, you represent that you have authority to bind that business, and “you” includes that business.
2. Who can use the service
You must be at least 18 years old and capable of entering into a binding contract. The Service is intended for use by businesses to collect and evaluate job applications. Individual job seekers who call the phone number or fill out the web form are not our customers — they are the customer's applicants — and different terms apply when they interact with us (described in our Privacy Policy).
You may not use the Service if doing so is prohibited where you live, or if you have previously been removed from the Service by us.
3. Your account
You are responsible for everything that happens under your account. Keep your password secure, keep your contact information current, and notify us immediately at support@myfriendlystaff.com if you suspect unauthorized access.
You may not share your account, resell access, or use the Service to operate a competing hiring or voice-AI service.
4. Subscription & billing
- Plans & fees. Paid plans (such as Sprout and Main Street Pro) are billed monthly in advance at the price listed on our pricing page at the time you subscribe. Fees are in US dollars unless stated otherwise.
- Free trial.If we offer a free trial, you can cancel at any time before it ends and you won't be charged. If you don't cancel, your plan renews at the standard rate.
- Auto-renewal.Subscriptions renew automatically each billing cycle until you cancel from your dashboard. You can cancel at any time — your plan stays active until the end of the current cycle, and you won't be billed again.
- No refunds. Except where required by law, fees already paid are non-refundable, including for partial months, unused call allotments, or downgrades.
- Usage limits. Some plans include monthly call or applicant allotments. If you exceed a hard limit, new applicant calls may be blocked until the next cycle or until you upgrade.
- Taxes.Prices don't include sales, use, VAT, or similar taxes, which you are responsible for where they apply.
- Price changes.We may change prices with at least 30 days' notice before the change takes effect for your account.
5. The Sign Shop (physical goods)
The Sign Shop is an optional add-on where we print and ship physical hiring signs (decals, placards, flyers). Separate rules apply to physical orders:
- Proofs.We'll show you a digital proof before printing. Once you approve the proof and we begin production, the order is final.
- Shipping. We currently ship within the United States only. Expected production and shipping times are estimates, not guarantees.
- Returns.Because signs are printed to order with your branding, they are non-returnable. If the product arrives damaged or materially different from the approved proof, contact us within 14 days of delivery and we'll reprint it at no charge.
- Your branding. By uploading a logo or business name, you confirm you have the right to use it and to let us print it on your signs.
6. Your content & applicant data
“Your Content” means everything you put into the Service: your business profile, screening questions, logo, and anything you upload. “Applicant Data” means the information applicants provide to us when they apply through your page or call your number — names, contact details, answers to your questions, call recordings, and transcripts.
Your Content belongs to you. You grant us a worldwide, non-exclusive license to host, process, display, and transmit Your Content solely to operate and improve the Service for you.
Applicant Data.With respect to Applicant Data, you are the “data controller” (you decide what to ask and what to do with answers) and we are the “data processor” (we handle it on your behalf). You are responsible for:
- making sure your job postings, questions, and hiring practices comply with applicable employment law (including equal- opportunity, anti-discrimination, and ban-the-box rules);
- providing applicants with any required privacy notices or consents, including notice that calls may be recorded and transcribed by an AI;
- responding to applicant requests to access, correct, or delete their data — we'll help you operationally, but the legal obligation is yours.

7. AI outputs & hiring decisions
The Service uses automated systems — large language models, voice transcription, and scoring — to summarize calls and rank applicants. These outputs are advisory. They can be wrong, biased, or incomplete, and they should never be the sole basis for a hiring decision.
You agree to use your own judgment before rejecting, interviewing, or hiring anyone, and to comply with all laws that apply to automated decision-making in employment in your jurisdiction (for example, New York City Local Law 144 if you hire in NYC).
8. Acceptable use
You may not, and may not help anyone else:
- use the Service to break the law, including laws about employment discrimination, consumer protection, telemarketing, wiretapping, or spam;
- use the phone number for anything other than receiving genuine job applications (no marketing calls, robocalls, or surveys);
- upload content that is unlawful, infringing, deceptive, or harmful;
- attempt to reverse-engineer, scrape, overload, or probe the Service, or circumvent usage limits or security controls;
- impersonate another business, or collect applications for a job you are not actually hiring for.
We may suspend or terminate accounts that violate this section, with or without notice, as appropriate to the severity of the issue.
9. Service availability
We work hard to keep the Service up, but we don't promise uninterrupted availability. We may perform maintenance, change features, or experience outages with our infrastructure providers. For the MVP, the Service is provided without a formal uptime SLA.
We rely on third-party providers (such as Supabase, Vercel, Vapi, Anthropic, Resend, and our telephony carrier). When they go down, parts of the Service may go down with them.
10. Ending the agreement
You can cancel your subscription at any time from your dashboard. You can delete your account by writing to support@myfriendlystaff.com.
We may suspend or terminate your access if you breach these Terms, if we're required to by law, or if your account has been inactive for an extended period. If we terminate for convenience, we'll refund any fees you've prepaid for service you won't receive.
After termination, we'll delete Your Content and Applicant Data within 90 days, except where we're required to retain it to comply with law or resolve disputes. Sections that are meant to survive termination (IP, disclaimers, liability, and governing law) continue to apply.
11. Our intellectual property
The Service, including the software, the website, the voice agent, branding, and all original content we create, belongs to us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service while your subscription is active. We keep all rights we don't expressly grant.
If you give us feedback or suggestions, you agree we may use them freely, without obligation to you.
12. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage.
We don't warrant that the Service will be error-free, that AI scoring will be accurate, that every call will be answered, or that any particular applicant will be qualified.
13. Limitation of liability
To the fullest extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or goodwill — even if advised that such damages were possible.
Our total aggregate liability arising out of or relating to the Service in any 12-month period will not exceed the greater of (a) the fees you paid us for the Service in that period, or (b) one hundred US dollars (US $100).
Some jurisdictions don't allow these limits. Where that's the case, the limits apply to the maximum extent permitted.
14. Indemnification
You agree to defend and indemnify us against any third-party claim arising from (a) Your Content, (b) your use of the Service, (c) your hiring practices or employment decisions, including claims by applicants, or (d) your violation of these Terms or applicable law. We'll let you know about the claim, let you control the defense (with counsel we find reasonable), and cooperate.
15. Changes to these terms
We may update these Terms from time to time. If the change is material, we'll give you notice by email or in the dashboard at least 14 days before it takes effect. Continuing to use the Service after the change means you accept the new Terms. If you don't accept, you can cancel your subscription.
16. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.
Any claim must be brought within one year after the event giving rise to it, or be permanently waived, unless applicable law requires a longer period.
